PROVIDENCE, R.I. (AP) - A 17-year-old West Warwick boy will be prosecuted as an adult for allegedly causing an accident that killed a mother of two.
Prosecutors say Graeme Kapko left a party on March 20, drove along Route 2 in Warwick alcohol in the car, then struck a station wagon driven by 46-year-old Luisa Avila, killing her instantly. Police estimate Kapko was going about 85 mph in a 45 mph zone.
Kapko has pleaded not guilty to driving to endanger with death resulting, transportation of alcohol by a minor, and possession of alcohol by a minor. He was freed on personal recognizance.
A Family Court judge waived the case to adult court at the request of prosecutors.
Kapko's lawyer says his client has no prior record and is remorseful.
