RI Man Indicted in April Accident That Killed Mother of 6

The Providence County Grand Jury handed up an indictment today naming David Hazard on one count of driving while intoxicated, death resulting, one count of reckless driving, death resulting, and one count of refusal to submit to a chemical test for the second time within five years. It is alleged that on or about April 7, 2009, David Hazard operated a motor vehicle while under the influence of intoxicating liquor with the death of Katherine O'Toole ensuing as a proximate result of an injury received by such operation of the vehicle, and that Hazard operated a vehicle in reckless disregard for the safety of others, with the death of Katherine O'Toole resulting. It is also alleged that on or about that same date, Hazard refused to submit to chemical tests, at the request of a law enforcement officer, for the purpose of determining the chemical content of his body fluids or breath, after having previously being convicted of refusal to submit in July 2008. All of the alleged incidents occurred in Scituate. Scituate Police conducted the investigation. The defendant will be arraigned in Providence County Superior Court on May 18, 2009.
