Rhode Island police have dismissed charges in the 2002 death of Jade Mawson.
Kimberly Mawson, Jade's mother, is no longer facing a 2nd degree murder charge in her daughter's death.
Mawson was convicted in her daughter Jade's murder and was sentenced to 35 years in prison.
After Mawson appealed her conviction, her attorney revealed that her boyfriend, Daniel Fusco, claimed responsibility in the killing.
After investigators analyzed the evidence they used against Mawson with Fusco's newly revealed claim, they determined they could not convince a jury beyond a reasonable doubt to convict her.
Fusco will not be facing any charges.
Investigation of Jade Mawson's death is once again considered an open case.
