UPDATE: Pedestrian walking dog, struck and killed by a 17-yo driver

The Bristol County DA's office announced Tuesday afternoon that the 17-year old driver responsible for Monday morning's fatal accident involving a 71-year old man and his dog has been served with a criminal complaint. Now that the teen has been served with the criminal complaint he will appear in court on September 23rd.

"The magistrate's hearing will be held to determine whether probable cause exists in the case and whether the criminal complaint will be officially issued. If the magistrate finds probable cause exists, Colin O'Hearne will then be officially charged and arraigned at a later date. If no probable cause if found by the magistrate, no charges would be issued."

The cause of the accident still remains under investigation.

A fatal accident is under investigation after officials say a 17-year old male driving a 2005 Infiniti sedan struck a 71-year old man and his dog.

Easton police arrived to Summer Street Monday morning locating the victim and his dog. The victim who has been identified as 71-year old George E. Power was rushed to Good Samaritan hospital in Brockton, MA where he was pronounced dead shortly after, his dog was also killed during the crash.

The 17-year old driver struck the victim and his dog before striking a tree and coming to rest, he was taken to Brockton hospital for non-life threatening injuries.

The cause of the accident is still under investigation, no charges have been filed against the driver at this time.
