Man who murdered ex-girlfriend to be sentenced

A man who pleaded guilty of murdering his ex-girlfriend will learn his fate on Tuesday.

Juan Diaz pleaded guilty to second-degree murder for the 2008 shooting death of his ex-girlfriend Mayra Cruz.

28-year-old Diaz was convicted three years ago and sentenced to two life sentences. The Rhode Island Supreme Court overturned the conviction noting that the jury instructions did not correctly explain the difference between first and second degree murder. More recently he was convicted by the Supreme Court again overturned th conviction noting that at least one jury had access to information about the previous case.

 Diaz was accused of shooting his ex-girlfriend then fleeing the scene. Diaz alerted his current girlfriend of the situation who alerted police. The girlfriend told police that Diaz had told her he accidently shot Cruz when the two got in an argument and he attempted to get the gun away from her. Diaz then fled to Albany New York
