A judge has ordered the Rhode Island Board of Education to hold a public discussion on reconsidering the NECAP, the state’s new test for high school seniors, as a graduation requirement.

On Friday, Superior Court Judge Luis Matos declared that the board was in violation of the open meetings law when it met in executive session last September to discuss a reexamination of the controversial NECAP requirement.

The American Civil Liberties Union of Rhode Island filed the lawsuit alleging the open meetings law violation after their organization, among others, filed a petition to reconsider the testing mandate.

The Board now has 30 days to hold the public meeting and discuss the matter and vote on the petition.
