North Providence forces gym to close down

A North Providence gym looses its fight with the town to stay open.

Thursday, the Zoning Board upheld a cease and desist order issued against Oceanstate CrossFit in April by the town Zoning Officer.

“The officials that issued it did not follow the rules of the zoning,” said Zoning Board Chairman Dennis Reall.

“Very disappoint,” said owner Mike Berling, “What’s gonna happen is we’re gonna have to lay some people off.  We’re gonna have to close up.”

The Charles Street gym has only been open since March.  They were invited to open up in town by Mayor Charles Lombardi, but after neighbors complained about noise the Zoning Officer started looking into the business.

Zoning Officer Kelly Morris discovered the location is not zoned for a gym.

Neighbors who have been fighting for the gym to close are pleased with the board’s decision.

“You know this whole time all we have been trying to do is get our normal noise levels, quality of life and lives back,” said resident Jay Metzger.

Owner Mike Berling isn’t ruling out legal action against the town.

“We don’t know what we are gonna do yet, suing the town is not on our list, but it’s not off our list.  We’re not taking anything off the table,” said Berling.

Berling could still make an appeal to the Superior Court, but he’s not sure if he will.
