Town asks court to order Sakonnet toll refunds

PROVIDENCE, R.I. (AP) _ The town of Portsmouth has asked a federal judge to order the Rhode Island Turnpike and Bridge Authority to use money it has collected from the Sakonnet River Bridge toll to pay the town's legal fees and refund motorists who cross the bridge.

The town filed a motion in U.S. District Court asking for restitution for the motorists. The town also asked to recoup its legal fees and expenses. The town sued RITBA in 2013 over the legality of the toll.

Town Solicitor Kevin Gavin said the town has paid about $70,000 in legal fees and $86,000 for the transportation experts they consulted.        

The toll was shut down last month.

Beth Bailey, a spokeswoman for RITBA, declined to comment. She said about $800,000 has been collected since the toll took effect in August 2013.
