Appeal denied for mom who murdered her daughter

An appeal has been denied for a North Kingston woman convicted of killing her 8-year-old daughter.

Kimberly Fry was convicted of second-degree murder in 2011; guilty of strangling her daughter after the little girl refused to take a bath.

Fry’s attorney requested a new trial with the hopes of proving she was mentally ill, to result in a less severe conviction. The defense claims she was taking a lot of pills at the time of the murder.

The Rhode Island’s Supreme Court has turned down the appeal request as prosecutors confirm that any effect the drugs had on the defendant can not be proven, which is why it was left out as an option during trial.
