COPS: Shooter 16, Victim 14 in Fall River Drive-By

On Tuesday May 18th, 2010 Fall River Police Officers Dwaine Cabeceiras, Nelson Sousa and Sgt. David Murphy, responded to the area of 267 Fountain St. in regard to a drive-by shooting. Upon arrival Officers observed a 14-year-old male suffering from an apparent gunshot wound to the right chest area. That victim was treated at the scene and then transported to Hasbro Children's Hospital, where he was last listed in stable condition in the Pediatric Intensive Care Unit.

Lead investigators, Det. Lawrence Ferreira and Steven Washington from the Fall River Police Department Major Crimes Division learned a vehicle drove by the area of 267 Fountain St. when several shots rang out with one round striking the 14-year-old. Information obtained from witnesses during an intense investigation and canvass of the area, by Major Crimes Division Detectives and members of the Uniform Division, led them to a Somerset residence on Roosevelt Ave. Search warrants were secured for the residence and a vehicle, which was towed into the Fall River Police Department. Evidence was collected including what is believed to be the firearm used in the shooting.

Arrested during the early stages of the investigation was 17-year-old Nicky Lee with an address of Randolph Ave. Tiverton, R.I. He is charged with:
1.Armed Assault to Murder
2.Carrying Firearm w/o License
3.Discharging Firearm Within 500 ft. of Building
4.Possession of Ammunition w/o FID Card

Also arrested was 21-year-old Sottarack Kyle Touch with an address of Harrison St. Fall River. He is charged with:
1.Armed Assault to Murder
2.Carrying Firearm w/o License
3.Discharging Firearm Within 500 ft. of Building
4.Possession of Ammunition w/o FID Card
5.A&B Dangerous Weapon
6.Numerous outstanding warrants for liquor, drugs, and larceny offences.

Two males are still wanted by the Fall River Police with regard to this incident. An arrest warrant has been issued for a 16-year-old Asian male identified as Mayoer Sareth Vann of 857 Pine St. Generally, the Fall River Police Department does not offer information on juvenile suspects, but the overriding public safety need in apprehending this dangerous and potentially armed individual takes precedence.  

Another warrant was issued for an 18-year-old Asian male identified as Thomas Phin of 859 Pine St.

The Fall River Police Department was assisted by the Somerset Police Department, Massachusetts State Police along with Assistant District Attorney Aaron Strojny, and numerous citizens who provided information.

Fall River Police Department Chief Daniel S. Racine states, “While it is disconcerting that a 14-year-old is the victim of a drive-by shooting; it is of grave concern that the alleged shooter is just 16-years-old. The good news is the victim is expected to recover, the shooter has been identified and will be arrested and most importantly, the MCD Detectives have recovered a .380 caliber semi-automatic pistol”.
