New Bedford Man Charged with Manslaughter in Fatal Hit and Run

Prosecutors say the hit and run that killed a man in Fairhaven this weekend was no accident.

Richard Martinez, 33, was arraigned in New Bedford District Court Monday on charges of manslaughter and leaving the scene after running over Jose Martinez, 49, Friday night.

Prosecutors say four men, including both of the Martinezes, were driving in a truck down Francis Road in Fairhaven. The plan was to drop Jose Martinez off at his home, but then a fight broke out.

Richard Martinez was driving the vehicle. He says someone in the back seat held a gun to his head and he panicked. His lawyers say all he remembers is hearing a thump, and that is when he knew he hit Jose Martinez.

About a dozen of Jose Martinez's relatives were in the courtroom Monday to catch a glimpse of the man whose charged with killing their loved one.

“I was with him for Christmas, New Year's and now we don't have him anymore…,” John Oquendo, the victim's brother said as tears filled his eyes outside the courthouse. “I want justice. I want to make sure that the guy we caught goes to jail for life. That's what I want.”

Police are still searching for the two other men who were inside the truck at the time. Richard Martinez is being held on $15,000 bail.
