Lawsuit filed against owners of Warwick Hooters

A federal lawsuit has been filed by Hooters parent company against the owners of the franchise that operates the restaurant in Warwick.
The suit claims that Hoot Owl Restaurants LLC out of Delaware abandoned the restaurant in Warwick and one in Delaware thereby damaging the reputation of the chain.
Last winter the Warwick location shut its doors because of storm damage to the roof and never reopened. The lawsuit claims that is a breach of contract.
Prior to that closure, there were a slew of health department complaints including takeout containers stored on a shelf with mouse droppings and a foul odor coming from the walk in refrigerator that was possibly from chicken dripping onto the floor.
The suit saying, "The Warwick Restaurant was in such deplorable condition in July 2014 that Hoot Owl voluntarily closed the restaurant."
A 2013 complaint cited in the suit reads in part "In the last year this place has gone to hell."
The complaint goes on to discuss dirty windows and that the men’s room had a strong stench of urine.
The suit saying at that point, "Despite repeated assurances from Hoot Owl, the Warwick Restaurant was not remodeled and the condition of the restaurant worsened."
We did reach out to Hoot Owl for a comment on the suit so far we have not heard back.
