Where's the evidence? This question seemed to be one of the main themes during today's federal court proceedings. A smiling tom Brady left the courtroom, after a federal judge grills the NFL's lawyer about Brady's involvement in the deflate gate.

"Nash can't give him a straight answer because you know what, there is none. There is no direct evidence that ties Brady to specifically conspiring or having something to do with deflating these footballs," says ABC 6 Legal Analyst Ken Schreiber.

ABC 6 Legal Analyst Ken Schreiber says from what he heard today, Tom Brady has the advantage.

"You draw conclusions. Whose he asking questions to? the NFL. Well what he asking them? Where's the evidence against Mr. Brady? Oh! That's what every defendant wants to hear,"says Schreiber.

Schreiber says he's not sure Brady will get off scott free though. Brady's lawyer conceded that Tom could have handled things better, Schreiber says a lack of compliance can come with a penalty.

"Cooperation, or a lack there of does allow discipline, but not four games!"adds Schreiber.

If there is no settlement, the two sides will be back in front of Judge Berman next Wednesday. The NFL has insisted that Brady accept the findings in the Ted Wells report, but Schreiber says, that's not going to happen. He does say he wouldn't be surprised if there was some type of agreement in place before next week's court date.
