Patino found guilty of 2nd degree murder

33-year-old Michael Patino, of Central Falls, has been convicted of second degree murder in the beating death of his girlfriend’s son.

Patino was found guilty Wednesday in Providence Superior Court and faces 10 years to life for killing 6-year-old Marco Nieves in 2009.

Text messages Patino sent to his ex-girlfriend, Trisha Oliver, reveal that he admitted to hitting the child on October 3 of 2009. Marco died a day a day later due to internal injuries and a hole in his intestine, according to the state medical examiner’s office.

The defense argued that the mother, Oliver, should have taken the boy to the hospital when he showed signs of sever pain, which may have saved his life. She was not charged.

Patino’s attorney, David A. Cooper, says they will file a motion for a new trial for an appeal in Supreme Court.
