PROVIDENCE, R.I. (WLNE) – A second motion has been filed to allow the Foxy Lady nightclub to retain their liquor licenses.

According to the filing, the club hopes to reverse the decision to revoke their extended hours and nightclub liquor licenses, initially revoked by the Department of Business Regulation on December 19th.

The Department later ordered a conditional stay of the Foxy Lady’s Class N nightclub license.

Now the club is seeking to amend the stay to include their Class BVX license, which would allow the establishment to stay open and serve liquor until 2:00 a.m.

A hearing officer recommended the club be allowed to retain their extended hours license on the condition that a Police detail be assigned on Friday and Saturday nights, as well as any openings the night before a State holiday.

According to the filing document, a hearing will be scheduled at a future date to discuss the possibility of the stay.

The club was allowed to reopen after a decision Thursday by the Rhode Island Supreme Court.
