Jury in North Kingstown ‘naked fat test’ trial continues deliberation

WAKEFIELD, R.I. (WLNE) —

The jury spent most of last week deliberating, and court did not meet Friday due to a scheduling conflict.

Thomas is charged with one count of second-degree child molestation and one count of second-degree sexual assault.

Thomas admitted on the stand that he did perform “fat tests” while students were naked as part of a fitness program, but said there was no sexual motive.

Thomas has pleaded not guilty.

Last week, a juror was dismissed because of a “potential conflict of interest,” leading to the jury having to restart with an alternate added.

If that were to happen again, the court would call a mistrial.

If the jury finds Thomas not guilty of the two felony charges, they will then consider a lesser misdemeanor battery charge.
