SCOTUS sides with Cranston man claiming police illegally seized his guns

WASHINGTON, D.C. (WLNE) – The United States Supreme Court ruled Monday against police who entered a man’s home and seized his guns without a warrant.

The case goes back to 2015.

That’s when Edward Caniglia of Cranston placed a gun on his dining room table and asked his wife to shoot him following an argument.

She left and went to a hotel and then called police the next morning.

Police determined he was a risk to himself. They later called an ambulance to take him to a hospital, and seized his weapons.

On Monday the Supreme Court unanimously agreed doing so was not covered under the fourth amendment’s “community care taking exception.”
