A witness at Rasputin’s Tavern told police that 22-year-old Brandyn Arruda showed them his weapon.
The 22-year-old admitted to police that he had a gun, but said he threw it out the window in Cushman Park.
The gun was recovered by police who found it near the entrance to the track.
The firearm, a 9mm H&K P30SK handgun, was legally owned by Arruda
Arruda was charged with assault with a dangerous weapon, interfering with police, carrying a firearm while intoxicated, disorderly conduct and failing to stop for police.
