Michelle Carter due in court today

Taunton, Mass. — The Plainville woman who sent text messages to her boyfriend encouraging him to kill himself faces a judge Friday.
Her attorney’s are arguing that the key evidence in this case was obtained illegally.
The defense attorney for 20-year-old Michelle Carter alleges she was not read her rights before being questioned by two Fairhaven detectives, and that she was forced to give up her passwords for her phone and laptop.
Carter is being charged with involuntary manslaughter in the death of her 18-year-old boyfriend Conrad Roy
She is accused of sending Roy dozens of text messages encouraging him to kill himself.
Roy’s body was discovered in his truck outside a Fairhaven Kmart in July 2014.
Carter’s lawyers have argued from the beginning that her texts are free speech and she is not responsible for Roy’s suicide.
Court documents filed by the defense state that Carter was questioned by police without being read her Miranda rights; therefore, all the information they have obtained from that interview should be thrown out including texts and Facebook messages.
Michelle Carter will appear in Taunton Juvenile Court Friday morning.
Carter’s lawyers are arguing that the jury should not be allowed to hear statements she made to police. That motion to suppress evidence will be heard in Taunton Juvenile Court Friday.
