EXCLUSIVE: Source inside 38 Studios Negotiations Speaks Out

A reliable source inside the 38 Studios negotiations tells ABC 6 News that former Red Sox Pitcher Curt Schilling would only settle his portion of the case if two things happened. To quote that tipster, "1. They would admit that he (Curt Schilling) did nothing wrong, and 2. He would pay not one penny, ever, for anything that happened."

"For those details you should talk to the Judge," said Governor Gina Raimondo. "What I can tell you is that Curt Schilling caused a lot of people a lot of pain in Rhode Island, cost our tax payers a lot of money and I’m very happy that we were able to settle with him and get millions of dollars."

Last week, Schilling, along with the company’s insurer and three others agreed to pay $2.5 million dollars.

We did reach out to the mediator the Governor mentioned, Judge Francis Darrigan, but ultimately we were referred to the Attorney for the Rhode Island Commerce Corporation Max Wistow.

Wistow calls the remarks "not true." He points to a public settlement agreement which does not specify any of those terms.

When it comes to the money in the settlement, 38 Studios’ Insurer is paying the bulk of the sum.

In terms of culpability Wistow tells us, "All the defendants deny they did anything wrong. But, the Commerce Corporation does not agree."

Curt Schilling says he will withhold public comment until all legal business is finished and "money is in their hands". Though, he does say when that happens he will tell everyone what actually happened.

First Southwest, 38 Studios financial adviser, is the only defendant which has not settled. They are preparing for trial next month.

No criminal charges have been filed in the 38 Studios case.
