UPDATE: Man wanted for murder of N. Carolina police officer fights extradition

Providence, R.I. — The man accused of killing a North Carolina police officer is fighting his extradition back to that state.
23-year-old Irving Fenner appeared before a judge in Kent County Court Thursday morning.
A judge says he will appear in court again in October.
Fenner was arraigned at Rhode Island State Police headquarters Wednesday night.
The suspect was wearing hospital scrubs and a sling on his left arm as he appeared for a very quick arraignment before a justice of the peace.
Police say Fenner shot and killed Officer Tim Brackeen of Shelby, North Carolina. He is facing charges as a fugitive of justice and for 1st degree murder.
"Although this defendant’s apprehension will not bring back officer Brackeen, it is our deepest hope that Mr. Fenner’s removal from the streets and his being held accountable for his actions will begin the healing process for the police department and his family," said State Police Col. Steven O’Donnell.
On Saturday North Carolina police went looking for Fenner, who was wanted for robbery and kidnapping. Officer Brackeen did find him, but was greeted with gunfire. He died on Monday. In the Meantime, Fenner took off sparking a nationwide manhunt.
"We began conducting cell phone analysis. That analysis led us to Rhode Island," said Colin Woods with the FBI.
Police say Jalisa Peeler, Fenner’s half sister, went to North Carolina and brought him back to Rhode Island. Tuesday night swat teams raided Peeler’s apartment in Providence, there was no sign of Fenner. They eventually found on Tiogue Avenue in Coventry just after 2 am.
"I heard a lot of banging. They kept coming on the mic and saying come out with your hands up," said neighbor Tho Chanthanarangsy.
The apartment where Fenner was found belongs to Corry Peeler and his girlfriend Hope Wyman. Peeler is Fenner’s uncle. Police say Fenner did not put up a fight once they found him.
"He was arrested without incident and observed to have a gunshot wound in the lower area of his left torso," said O’Donnell.
Jolisa Peeler is charged with accessory after the fact. Corry Peeler and Hope Wyman are charged with harboring a criminal.
