The House Oversight Committee investigating the failed 38 Studios deal has voted to ask the Speaker of the House to order a subpoena for Curt Schilling to testify before them.
The committee’s vote was unanimous. Speaker Mattiello says he will approve that request, likely on Friday.
"It certainly shows unity within this committee that we all want the answers," said The Chairwoman of the House Oversight Committee Karen MacBeth.
MacBeth says Schilling has some key information that they are looking for.
"He is the only one who has a perspective of the initial meetings–who he met with, what was discussed, who else was in that meeting, and how this all transpired," said MacBeth.
The former Red Sox pitcher hasn’t publicly answered questions about how the deal went wrong and he was not deposed in the lawsuit.
"We haven’t heard from somebody inside of the company directly," said State Representative Michael Chippendale.
The committee asked Schilling to voluntarily come forward earlier this month. His lawyers sent back a letter declining, citing pending litigation.
As to what power this subpoena will actually have in making him come to the state, lawyers for the committee say it likely won’t be enforced in Massachusetts where Schilling resides.
"The short answer is yes, pursuant to that statute I mentioned with the speaker’s approval you can get subpoena power within the state and it will be honored. If there’s a question about whether they will be honored out of state, the short answer: anywhere between no and probably not," said Chippendale.
The Committee says Schilling’s is just the first of several subpoenas they plan to issue. Among those they want to talk to is Michael Corso, the former 38 Studios attorney.
