In a Supreme Court decision made public Wednesday a suspended Cranston Police captain can be prosecuted for his roll in the departments parking ticket scandal.

Judge Alice Gibney ruling against Stephen Antonucci in his lawsuit against the police department, Mayor Allan Fung and the state police and won’t block the prosecution of the captain on non-criminal charges.

Antonucci had tried to convince the judge that state police conducted an illegal investigation that led to charges against him.

According to the Providence Journal, unless he appeals to the state Supreme Court or reaches a settlement his case will now get to a disciplinary tribunal.

Antonucci is accused of ordering a massive parking ticket sweep back in 2013 in the districts of two council members who voted against a new police union contract.
