Judge: Title IX lawsuit against Brown University to move forward

A Federal Court judge ruled Monday to allow a former student’s lawsuit to proceed against Brown University in a wrongful sexual misconduct investigation.

Judge William E. Smith ruled that on the charges that Brown violated the students due process rights and discriminated against him based on his gender, the case has the legal standing to proceed.

Judge Smith did rule to dismiss claims made against Brown University including Erroneous Outcome under Title IX and Breach of Contract, while allowing the claims of Deliberate Indifference under Title IX and Negligence.

The student filed the lawsuit in April 2015.
