Man charged with DUI, allegedly found unconscious with child in car pleads not guilty

WARWICK, R.I. (WLNE) — A man from Attleboro pleaded not guilty for on DUI charges, after police said he was found unconscious with a child in his car.

James Colbert, 32, was found sleeping in a vehicle on Old River Road partially parked on a residential lawn and walkway back in July.

Colbert was allegedly found to show signs of intoxication including slurred speech, bloodshot eyes and a strong odor of alcohol.

Colbert performed field sobriety tests and was arrested on charges of DUI (first offense), driving under the influence with a child under 13, refusal to submit to a preliminary breath test, refusal to submit to a chemical test and leaving lane of travel.

The child was released to a family member at the scene and DCYF has been notified of the incident.

Colbert was referred to a public defendant on Monday, and will be back in court on September 9.
