Prosecutor says Tsarnaev wrote “defiant” notes in hospital

Transcripts of a sidebar conversation between attorneys this week in the penalty phase of the trial for convicted bomber Dzhokhar Tsarnaev reveal a Federal Prosecutor saying that the now 21-year-old wrote “defiant” notes while injured in the hospital after his 2013 capture.
The Government saying that they would like to show those notes to the jury to counter the defense’s argument that Tsarnaev was never “defiant, hostile or uncooperative,” with an assistant US Marshall following his arrest.
This conversation taking place in the midst of that US Marshall’s testimony.
In the sidebar conversation on Wednesday Assistant US Attorney William Weinreb said Tsarnaev wrote “one defiant note after another” in his hospital bed.
You’ll recall following the attack Tsarnaev had been shot in the face and was unable to talk.
The only witness to take the stand on Thursday was Mark Bezy,a former death row prison warden.
His testimony picked up with the Government grilling him during cross examination about what life would really be like for Tsarnaev if he is sentenced to life in prison.
The judge ended the day early after several delays.. saying there is a lot for attorneys to review.
The defense had wanted to call Sister Helen Prejean, a nun and anti death penalty advocate, who inspired the movie Dead Man Walking.
The Government had indicated they would file a motion to prevent her from testifying.
We expect the defense to finish up their case early next week.
