UPDATE: Hearing postponed for Guatemalan man detained by ICE in car window smashing incident
PROVIDENCE, R.I. (WLNE) — A Guatemalan man arrested by ICE in New Bedford was expected to appear in court Thursday, but his hearing has been postponed until September.
According to Mendez’s attorney, Juan Mendez will have a bond hearing on May 29 which will determine whether a judge orders ICE to remove his ankle monitor, along with other conditions on his release.
Earlier this month, a judge ordered the release of Mendez who was taken into custody while taking his wife to a dentist appointment.
The arrest of Mendez garnered national attention largely from the viral video of an ICE agent smashing the couple’s car window.
According to the Boston Globe, Mendez’s wife was granted asylum last year, and Juan Mendez has no criminal record.
Mendez’s lawyers tell ABC6 that he remains in ICE custody despite the judge’s order.
