Warwick man sentenced in drunk driving incident that killed cyclist

WASKEFIELD, R.I. (WLNE) — A Warwick man was sentenced Wednesday after being convicted of charges stemming from a deadly 2024 DUI crash.

According to Tim Rondeau, Director of Communications for Attorney General Peter Neronha, Daniel Famiglietti, 60, will serve seven years at the ACI after being convicted in the North Kingstown incident.

He also faces a $5,000 fine, alcohol counseling and a five year driver’s license suspension upon completion of his sentence.

He pleaded nolo contendere to one count of driving under the influence resulting in death.

The incident occurred at approximately 7 p.m. on June 20, 2024 when North Kingstown police responded to a crash at the intersection of Boston Neck Road and Earle Drive.

Famiglietti was traveling north on Boston Neck Road in a Jeep when he struck 53-year-old Linda Sherman who was also traveling north on a bicycle.

Investigators determined that Sherman was riding her bicycle in the breakdown lane when Famiglietti struck her from behind.

Sherman was transported to an area hospital where she later died from her injuries.

Famiglietti told police that he had consumed several alcoholic beverages before he got on the road and consented to and failed field sobriety tests.

Famiglietti refused a chemical blood test.

Three hours after the incident, his blood alcohol concentration (BAC) was found to be .097 percent after a warrant was obtained for the test.

The legal limit for BAC in Rhode Island is .08 percent.
